Health, Safety and Environment
First prosecution under IPPC
A waste company has been fined £20,000 for a breach of an IPPC permit.
It was a condition on the permit that odours were not to develop at levels
likely to cause pollution or harm to human health or serious detriment
to the amenity of the locality outside the site boundary. The landfill
gas flame had gone out and unburned gases were being vented. It was alleged
that the landfill gas odours were strong enough to wake local residents.
IPPC – have you registered?
To-date, some 120 companies have applied for permits under IPPC legislation.
This is less than the anticipated number of companies who are believed
to be over the 30 m3 threshold. It has been made clear by the Environment
Agency that offenders will be prosecuted. You have been warned on several
occasions by both SEA and IMF so it’s no good saying‘you did
not know!
Consultation on amendments to IPPC (Scotland) Regulation 2000
The consultation paper seeks comments on proposed amendments including:
● detailed proposed changes to the regulations
● draft amendment regulations
● a list of consultees

Proposed 2005-06 Fees & Charges from Welsh Assembly
It is the practice of the Welsh Assembly to consult stakeholders and local
authority associations as part of the annual review of the local authority
charging schemes. It is proposed that LAPC fees and charges for 2005-6
be increased by 5% over current levels Copies of the proposals can be

HSE targets Manufacturing Industries
HSE has launched a new enforcement led campaign to reduce the unacceptably
high number of fatal and serious accidents that continue to occur in industry.
The nation-wide campaign will see HSE inspectors targeting various industry
sectors over the next three years to ensure that correct procedures are
in place for working on machinery. During the past three years over 40
people have died as a result of incidents in manufacturing industry, most
commonly when cleaning machinery blockages or carrying out running repairs
without the correct safeguards, in particular not properly managing isolation
and lock-off procedures to ensure there is no power feed to equipment.
The campaign aims to:
● Raise awareness about the risks and standards
required for safe isolation and lock-off
● Ensure, through formal enforcement, that robust
isolation and lock-off procedures are implemented
● Ensure that employers have, or are putting in
place, sound risk control systems for managing
these procedures.
Investigating Accidents and Incidents
HSE has published new guidance on how to investigate accidents and incidents,
including near
misses. The guidance is aimed primarily at small to medium-sized enterprises,
where it is often difficult to build up an expertise in investigating,
although larger organisations may also find the guidance helpful.
The four steps featured in the guidance are:
● gathering information
● analysing information
● identifying risk control measures; and
● action plan and its implementation.
Said Jonathan Russell of HSE’s Enforcement Policy branch ‘To
have one accident is bad enough, but to have a further accident because
lessons were not learnt is inexcusable’. HSE believes that the best
people to make workplaces safer are the staff and managers who work in
them. This guidance provides a tool for them to find out what went wrong,
learn
lessons and take action to reduce or prevent future accidents. Copies

Contaminated land is waste
A recent European Court of Justice decision is likely to have significant
and far-reaching implications. The question for the court was whether
hydrocarbons which had spilled, causing soil and groundwater contamination
were to be regarded as waste within the meaning of the Waste Framework
Directive. The court’s finding was yes. The moral must be don’t
let materials enter the site – if you do and then move toanother
site you may have to take the contaminated
material with you or pay for expensive remedial work.
National Laboratory Service (NLS)
The NLS is an internal business unit within the Environment Agency in
which there is a group called the NLS Waste and Contaminated Land Service,
This group has been set up to provide an analytical service to customers
who need specialist analysis for waste and contaminated land. The service
is based at two NLS sites – the Waterlooville Laboratory for landfill
leachates, contaminated land and asbestos, whilst for landfill gas, hazardous
or unknown waste and ambient

DEFRA– PFOS Consultative Document
DEFRA have prepared a consultative document on the proposed national action
to restrict the use of perfluorooctane sulphonate (PFOS) and substances
that degrade to PFOS. One use of this substance is as a mist suppressant
in hexavalent chromium plating. PFOS is a persistent, bioaccumulative
and toxic and a risk to the aquatic and terrestrial environment. It is
suspected of causing cancer and may be toxic for reproduction. The consultative

Prosecutions
Following an investigation by HSE, a company and its officers was fined
a total of £245,000 in relation to the removal of asbestos. The
company was contracted to clear and strip out a site prior to it being
converted by a development company. A team of inexperienced worker ranging
in age from 16 to 26 were hired without any warning of the risks associated
with asbestos. An
HSE inspector said that this was one of the worst situations she had come
across, not only the asbestos risk but also that work was allowed to go
ahead despite concerns of the workforce.

Nigel Bond, sales director of Dulux Trade Paints, has been elected President
of the British Coatings Federation, the trade association that represents
the paint, coatings and printing ink production industries in the UK.
Mr Bond has been employed with ICI paints for over 30 years, involved
in aspects of raw materials purchasing, packaging and trade marketing.

Jewellery Handbook – Electroforming
A new book on the subject of electroforming, aimed at crafts people has
been written by Les Curtis, senior lecturer at the School of Jewellery
of the University of Central England. It is a new addition to the ‘Handbook’
series conceived as an introduction to the various topics and techniques
relating to making of jewellery. Published by A & C Black of London
and selected as

BSTSA Guide
The BSTSA have published a Health and Safety guide for surface finishing
‘tank side’ personnel. It contains advice and assistance for
employers on how to carry out work responsibilities in a safe manner.
Topics covered include induction training, protective clothing, good housekeeping,
handling chemicals, tank side work, filtration equipment, process heating,
loading and unloading, fork lift equipment, portable equipment and maintenance.

Aleo Plating Ltd received SFI grant
The Northwest Regional Development Agency (NWDA) is pleased to announce
that the first company in Liverpool to receive a Selective Finance for
Investment (SFI) award is Aleo Plating Ltd. Aleo is a specialist metal
finishing company servicing sectors ranging from aerospace and automotive
to construction and home furnishing. The grant, part of a capital investment
programme, will assist in the introduction of a new finishing line to
help meet the growing demand from its customers.

Technician of the Institute of Metal Finishing – TechIMF
The Examination & Qualification Board have recently made it possible
for those persons holding the Technician Certificate, but unable to attend
for interview, to apply for the TechIMF qualification. The regulations
governing the award have recently been revised to accommodate applicants
who are in this situation. Applicants must submit a written statement
covering the following:● Summary of work experience in the surface
finishing indutry
● Use of IT skills
● Example of a solved technical problem
● Lectures, presentations given and papers
published
● Courses, conferences, seminars attended
● Knowledge and responsibilities with respect to Health & Safety
and Environment legislation
On receipt of the above, the applicant will have a‘telephone interview’
with a professional member of the IMF, following which the application
will be evaluated. However, this new non-interview procedure, whilst satisfying
the IMF’s regulations, still has to be evaluated for acceptance
for EngTech qualification of the Engineering Council – ECuk. Interested
